Annual Consent (SB12 FAQs)

During the 89th Texas Legislative Session, Senate Bill 12 was passed, requiring all Texas public school districts to get yearly parental consent before providing routine school-based health services.

Examples of routine health services that that may be provided with your consent:

Physical Health Services (by school nurses or athletic trainers):

• Monitoring of chronic health conditions 
• Administration of over-the-counter medications in accordance with law (separate authorization form required)
• Administration of prescription medications in accordance with law (separate authorization form required)
• Monitoring and treatment of chronic health conditions (e.g., asthma, diabetes) per physician’s orders
• Coordination of health services
• Any additional health-related services that the campus may believe are necessary and appropriate will necessitate separate written consent and parental involvement, unless during an emergency or as allowed by law.

Mental Health Services (by school counselors or mental health staff):

• Short-term individual counseling or check-ins
• Social-emotional small group support
• Support during emotional distress or crisis
• Behavioral observations and problem-solving strategies
• Referral to community providers, if needed (with additional consent)

Parental Consent is not required for these services:

• School district emergency responses
• Law enforcement or Department of Family and Protective Services activities
• Behavioral threat assessment required by law
• Other rights or duties required by law, including the Texas Family Code
• Routine counseling services including: 
  • Guidance curriculum
  • Responsive services
  • Individual planning
  • System support

• Medical or psychological diagnosis
• Administration of scheduled prescription medications
• Administration of over-the-counter medications
• Scheduled nursing procedures
• Long-term therapy or treatment that legally requires separate parental notification or consent
